Abstract
Der moderne Verfassungsstaat beruft sich auf das Volk als Legitimationsgrundlage. Der Begriff des Volkes erweist sich bei näherer Betrachtung jedoch als opak. Dies ist darauf zurückzuführen, dass die Beziehung zwischen den Einzelnen und der Gemeinschaft sich ganz unterschiedlich darstellt in Abhängigkeit davon, ob die Einzelnen als Menschen, als Personen oder als Individuen konzeptualisiert werden. Aus den unterschiedlichen Statusbestimmungen der Einzelnen ergeben sich unterschiedliche Sphären der politischen Integration, denen der Staat durch funktionale Ausdifferenzierung gerecht werden muss. Dabei kommt dem Raum der Öffentlichkeit zentrale Bedeutung zu. Vor dieser Folie wird die These entfaltet, dass die Europäische Union nur in eingeschränkter Bedeutung als demokratische Institution betrachtet werden kann, weil ohne europäische Öffentlichkeit auch kein europäisches Volk existiert. The modern constitutional state relies on the people as the basis of its legitimacy. On closer examination, however, the concept of the people proves to be opaque. This is due to the fact that the relationship between the many and the community is portrayed very differently, depending on whether the single men and women are referred to as human beings, as persons, or as individuals. Different spheres of political integration result from these different status designations, which the state must take into account by means of functional differentiation. In this context, the space of the public sphere is of central importance. Against this background, the thesis is developed that the European Union can only be regarded as a democratic institution in a limited sense, because without a European public sphere there is no European people.
